Pat Poon to court back in 2008 over statements he made in his book, Dr. Poon’s Metabolic Diet, and in a Chinese-language TV interview disparaging the Dr. Bernstein diet for being, among other things, “very low calorie” and “like starving.” The judge didn’t have much sympathy for either side. “This dispute arises at one of the many intersections between business and profit on the one hand, and health and wellness on the other. Both (Bernstein and Poon) are, financially, the beneficiaries of the burgeoning needs and demands of an increasingly obese population,” noted Ontario Superior Court Justice Graeme Mew in his lengthy judgment.

“In my view, this case is more about ego than injury. It is more about turf warfare in the competitive world of diet medicine than about reputation.” Poon, a little fish in the lucrative weight loss industry, is a family physician who operates four clinics in the GTA which treat patients with obesity and related complications.

In the second edition of his self-published diet book, his chapter — “Pros and Cons of Different Diets” — “sometimes clumsily,” as the judge said, criticizes other schemes in the marketplace, including the one offered at Bernstein’s 62 centres throughout Canada. Poon did so by getting at least some facts wrong — he said Bernstein’s diet claimed a weight loss of 20 pounds a week when it’s really up to 20 pounds a month. But Mew ruled that most of Poon’s criticisms about the Dr.

Bernstein diet could be considered fair comment and defensible under our libel laws: Other critics have also said it doesn’t provide enough calories or protein. “The subject of diet and nutrition is one of unending debate between scientists, health care professionals, welfare agencies and commercial parties,” Mew wrote. “I am satisfied the reasonable person would understand Dr. Poon’s views to be just that — his views on issues of diet and nutrition as opposed to declarations of existing fact.” The judge did find Poon liable for two incidents of defamation: in his book, he said the Bernstein diet falsely claims to boost patients’ metabolic rate through vitamin injections — a claim the diet has never made — and in his TV interview, Poon suggested the Bernstein clinics aren’t staffed by doctors when they are.
